By accessing or using the website at masonryvista.com (the "Site") or by engaging Vista Concrete and Masonry ("we," "us," or "our") for any masonry or concrete contracting service, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this Site or engage our services.
Vista Concrete and Masonry provides residential and commercial masonry and concrete contracting services in Vista, CA and surrounding communities. Services include, but are not limited to, foundation repair, chimney repair, brick repair, tuckpointing, retaining wall construction, driveway pavers, walkway construction, fireplace installation, stone veneer installation, and related masonry work. Specific services to be performed are set out in the written estimate or contract provided to each client prior to work beginning.
All prices quoted are estimates based on information available at the time of assessment. A written estimate will be provided before any work begins. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
If conditions discovered during the course of work materially differ from what was apparent at the time of the estimate - for example, hidden structural damage, unanticipated soil conditions, or existing unpermitted work - we will notify you in writing before proceeding with any additional work, and a revised estimate will be provided for your approval.
We reserve the right to decline any project at our discretion prior to executing a written agreement.
Project start dates are scheduled based on availability and subject to change due to weather, permitting timelines, or other factors outside our control. We will notify you as soon as reasonably possible of any schedule changes.
If you need to cancel or postpone a scheduled project, please notify us at least 48 hours in advance. Cancellations with less than 48 hours notice may result in a cancellation fee as specified in the written agreement, particularly if materials have been ordered or crew time has been reserved.
We reserve the right to postpone or cancel work due to unsafe site conditions, inclement weather, or other circumstances that would compromise the quality or safety of the work.
Payment terms will be specified in your written estimate or contract. In general, a deposit may be required before work begins, with the balance due upon project completion unless otherwise agreed in writing.
Accepted payment methods will be stated on your invoice. Invoices not paid within the period specified in the written agreement may be subject to a late payment charge. If collection efforts become necessary, you agree to reimburse us for reasonable collection costs, including attorney fees.
Ownership of any materials installed remains with Vista Concrete and Masonry until payment is received in full.
You are responsible for providing reasonable access to the work area on scheduled dates, securing or removing any personal property that may be affected by the work, disclosing any known conditions that could affect the project (such as underground utilities, prior repairs, or known structural issues), and obtaining any homeowner association approvals or consents required before work begins.
Failure to disclose known conditions that materially affect the scope or cost of work may result in additional charges or a revised estimate.
Where required by law or local regulation, we will obtain the necessary building permits from the applicable government authority prior to commencing structural work. Permit fees are typically included in the estimate or itemized separately. Work will not begin on permit-required projects until permits are issued. We will coordinate required inspections as part of the project. Any delays caused by the permitting authority are outside our control and may affect the project schedule.
We warrant our workmanship against defects in materials and labor for the period stated in your written contract. Warranty terms vary by service type and will be specified in writing prior to project commencement.
This warranty does not cover damage caused by misuse, neglect, acts of nature, settlement or movement unrelated to the repaired area, subsequent modifications made by others, or normal wear and aging. Warranty claims must be submitted in writing to contact@masonryvista.com within the warranty period.
To the fullest extent permitted by law, Vista Concrete and Masonry's total liability for any claim arising out of or related to services provided under these Terms will not exceed the total amount you paid for the specific service giving rise to the claim.
In no event will we be liable for indirect, incidental, special, or consequential damages, including loss of use, loss of profits, or damage to property not directly caused by our work, even if we have been advised of the possibility of such damages.

While we strive to keep it accurate and current, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, or suitability of the information on the Site for any particular purpose. Nothing on this Site constitutes professional engineering or structural advice for your specific property.
In the event of a dispute arising from services provided under these Terms, both parties agree to first attempt to resolve the matter informally by contacting us in writing at contact@masonryvista.com. We will respond within 10 business days.
If informal resolution is unsuccessful, disputes will be submitted to binding arbitration under the rules of the American Arbitration Association, unless both parties agree in writing to waive arbitration. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration will be brought exclusively in the courts located in San Diego County, California.
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of this Site or engagement of our services after any changes constitutes your acceptance of the updated Terms.
